LAWYERS SINGS THE BLUES: IMPAIRMENT, PRIVILEGE AND PROTECTIO
This musical program explored the tension between affording an impaired lawyer privacy and confidentiality as the lawyers sought treatment while at the same time protecting the public from the consequences of the lawyer's impairment. The presentation included vignettes that reviewed how a law firm should stirke a balance between protecting its clients while protecting the right of the attorney to privacy, whether privileges exist under state law that might protect impaired lawyers who seek treatment and what happens when the impairment of a lawyer constitutes a criminal offense. The program involved nine participants and a narrator who helped to flesh out important legal principles in the discussions between vignettes.
