How to Get Paid: Staying Current on Employment and Payment
While bankruptcy attorneys remain subject to the same body of state ethical rules governing the conduct of non-bankruptcy practitioners, getting paid can be a little trickier. Section 327 provides that a debtor in possession may "employ one or more attorneys...that do not hold or represent an interest adverse to the estate, and that are disinterested persons, to represent or assist the trustee in carrying out the [debtor in possession’s] duties under [the Bankruptcy Code].” This means that representing someone in bankruptcy court means a lot more hoops to jump through to receive compensation, and that the agreement with your client is not wholly private between attorney and client.
